Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and TestimonialX Inc. ("TestimonialX," "we," "us"). By creating an account, connecting your Twitter/X account, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years of age (or the minimum age in your jurisdiction) to use TestimonialX. By using the platform, you represent that you have the legal capacity to enter into these Terms. If you are using TestimonialX on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Account & Authentication

TestimonialX accounts are created and authenticated via Twitter/X OAuth 2.0. You are responsible for:

• Keeping your Twitter/X account secure and not sharing access credentials.
• All activity that occurs under your TestimonialX account.
• Notifying us immediately if you suspect unauthorised access.

You may only hold one TestimonialX account per Twitter/X identity. Creating multiple accounts to manipulate credits or exchange rankings is prohibited and may result in permanent suspension.

4. The Exchange Marketplace

The Exchange allows users to post tweets on behalf of other users in return for credits. By participating in the Exchange, you agree to the following:

• Explicit authorisation — you grant TestimonialX permission to post a specific, pre-approved tweet from your Twitter/X account only when you accept an exchange request.
• Content review — all exchange tweets must comply with Twitter/X's Terms of Service and our Testimonial Content Rules below. We reserve the right to reject any tweet before it is posted.
• No spam or manipulation — you may not use the Exchange to artificially inflate engagement, post misleading content, or engage in coordinated inauthentic behaviour.
• Credit obligations — credits awarded upon successful completion of an exchange are final. Disputes must be raised within 7 days of the exchange.
• Revocation — you may revoke your Exchange participation at any time. Active exchange commitments already accepted must be completed or forfeited according to our cancellation policy.

5. Credits & Payments

Credit system

TestimonialX operates a credit-based economy. Credits may be earned via the Exchange or purchased directly. Credits have no cash value and are non-transferable except within the platform as part of Exchange transactions.

Purchases

All credit purchases are processed by Dodo Payments. By making a purchase, you agree to Dodo Payments' terms and authorise the charge to your payment method. All sales are final unless a technical error on our part prevented credit delivery.

Refunds

Unused purchased credits may be refunded within 14 days of purchase, provided no credits have been spent. Credits earned through the Exchange are not refundable. To request a refund, contact support@testimonialx.com.

Credit expiry

Credits do not expire as long as your account remains active. If your account is suspended for policy violations, unused credits are forfeited.

6. Testimonial Content Rules

All testimonials submitted, displayed, or posted via TestimonialX must:

• Be truthful and reflect a genuine experience with the product or service.
• Not impersonate another person or misrepresent your identity.
• Not contain defamatory, obscene, harassing, or unlawful content.
• Not infringe the intellectual property rights of any third party.
• Comply with applicable advertising and endorsement disclosure laws (e.g., FTC guidelines where applicable).

We reserve the right to remove any content that violates these rules without notice.

7. Prohibited Conduct

You agree not to:

• Use TestimonialX to post fake, misleading, or fabricated testimonials.
• Reverse engineer, scrape, or attempt to extract our platform data at scale.
• Circumvent any security measure, rate limit, or access control.
• Use automated tools, bots, or scripts to interact with the Exchange.
• Sell, transfer, or otherwise commercialise your credits or account outside the platform.
• Interfere with the integrity or performance of our infrastructure.
• Violate any applicable laws or regulations.

8. Intellectual Property

Our IP

TestimonialX, its logo, design, and software are owned by TestimonialX Inc. and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Your content

You retain ownership of testimonials and content you create. By submitting content to TestimonialX, you grant us a non-exclusive, royalty-free, worldwide licence to host, display, and distribute that content as part of providing our service, including on testimonial widget pages.

Twitter/X content

Any tweets posted via the Exchange remain subject to Twitter/X's Terms of Service. TestimonialX does not claim ownership of tweet content.

9. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, engage in fraud, or if required by law. Upon termination:

• Your access to the platform and all features will cease immediately.
• Remaining credits will be forfeited (except where a refund is owed per Section 5).
• Your data will be handled as described in our Privacy Policy.

10. Disclaimers & Limitation of Liability

TestimonialX is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability. We do not guarantee that the Exchange will always be available or that tweets will post successfully due to Twitter/X API limitations.

To the maximum extent permitted by law, TestimonialX's total liability for any claim arising from your use of the platform shall not exceed the amount you paid us in the 12 months prior to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

11. Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under [arbitration body] rules, except that either party may seek injunctive relief in court for intellectual property violations.

12. Changes to These Terms

We may update these Terms periodically. When we do, we will update the "last updated" date and notify you via email or an in-app banner at least 14 days before material changes take effect. Continued use of TestimonialX after the effective date constitutes acceptance of the revised Terms.
